Terms of Service & Scanning Agreement

Binding contractual terms governing access to LeakReport (leakreport.io), passive surface inspection tools, audit dossier generation, commercial packages, and digital deliverables.

1. Acceptance of Terms & Binding Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Client", or "You") and LeakReport, an operating brand of Generative Intellectual LLC ("Company", "LeakReport", "we", "us", or "our"). By submitting a domain name for inspection, requesting an exterior report, viewing scan previews, interacting with our search consoles, or purchasing commercial audit packages, you acknowledge that you have read, understood, and unequivocally agree to be bound by these Terms and our Privacy Policy.

If you do not agree to every provision of these Terms, you are strictly prohibited from using our website, submitting domains, or purchasing report deliverables.

2. Authority and Domain Ownership Representation

By entering any website address, hostname, or domain name into LeakReport, you expressly represent, warrant, and covenant that:

    Legal Authority: You are the verified owner of the submitted domain, or you are an authorized officer, employee, IT director, or legal agent of the domain owner with full authority to authorize an external surface reconnaissance scan.

    Prohibition on Unauthorized Inquiries: You will not submit domains belonging to third parties for malicious surveillance, harassment, competitive sabotage, or any purpose that violates state or federal computer fraud laws.
  • +
    Identity Accuracy: All credentials, corporate telephone numbers, and email addresses provided during intake are truthful, accurate, and belong to an authorized representative of the audited domain.

3. Scope of Service: Surface Reconnaissance Only

LeakReport provides automated, passive, non-invasive exterior technical inspections. You understand, acknowledge, and agree to the following technical limitations:

Surface Observations Only: Our inspection engines evaluate exclusively publicly reachable network interfaces, DNS zone records, SSL/TLS handshake configurations, HTTP response headers, client-side JavaScript execution, and publicly accessible web form attributes as rendered in an ordinary browser.

Not a Penetration Test or Code Audit: LeakReport does not inject exploit payloads, perform credential-stuffing tests, execute denial-of-service tests, review backend application source code, audit internal database configurations, or access authenticated intranet networks.

Point-in-Time Snapshot: Scan results reflect only observable public indicators at the precise millisecond of execution. LeakReport does not provide continuous 24/7 monitoring or real-time intrusion prevention unless expressly contracted under an independent enterprise service agreement.

4. Absolute Disclaimer of Warranties ("As-Is" & "As-Available")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEAKREPORT, ITS TOOLS, SEARCH CONSOLES, FINDING DOSSIERS, LETTER GRADES, RISK SCORES, AI FIX PROMPTS, CODE DIRECTIVES, AND DELIVERABLES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND DEFECTS.

LEAKREPORT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, LEAKREPORT MAKES NO WARRANTY OR REPRESENTATION THAT:

  • + The services will meet your specific business, security, or legal requirements;
  • + Your website is completely secure, impenetrable, or free from undetected vulnerabilities, backdoors, or malware;
  • + Our scan findings represent an exhaustive, complete inventory of every defect, breach, or compliance error on your website;
  • + Implementation of our recommendations or AI fix prompts will prevent cyberattacks, data leaks, ransomware, regulatory enforcement, or third-party lawsuits;
  • + The operation of the inspection utility will be uninterrupted, timely, secure, or error-free.

5. No Legal Advice & Non-Fiduciary Relationship

LEAKREPORT IS NOT A LAW FIRM, DOES NOT PRACTICE LAW, AND DOES NOT PROVIDE LEGAL ADVICE, LEGAL OPINIONS, OR ATTORNEY-CLIENT REPRESENTATION.

Any references in our scans, marketing materials, or report dossiers to statutes (such as the California Invasion of Privacy Act [CIPA Section 631], the Telephone Consumer Protection Act [TCPA], the Americans with Disabilities Act [ADA Title III], or the California Consumer Privacy Act [CCPA/CPRA]) represent technical observations and automated heuristic indicators only. They do not constitute formal legal conclusions or legal defense counsel.

You agree that you will not rely upon LeakReport deliverables as a substitute for consultation with licensed legal counsel. No attorney-client relationship, fiduciary duty, or confidential legal privilege is created through your use of our services.

6. Turnkey AI Fix Prompts & Developer Remediation Disclaimers

Commercial packages (including Tier 3) include Turnkey AI Fix Prompts (ai-fix-prompts.md) and configuration snippets designed for artificial intelligence models (such as ChatGPT, Claude, and Cursor) or human developers.

You and your web development personnel bear sole, independent, and exclusive responsibility for reviewing, testing, verifying, and validating all code snippets, server directives (Apache, Nginx, Cloudflare), and cookie configuration rules prior to deploying them into production environments.

LeakReport assumes zero liability for website downtime, server crashes, script errors, broken functionalities, loss of user sessions, or data corruption resulting from the deployment or misapplication of any remediation prompt or directive.

7. Re-Scan Verification & Clean Certificate Terms

Our 60-Day Re-Scan Verification Guarantee and verification certificates certify solely that our automated surface-level scan engines did not observe the specific tested heuristics at the single moment the re-scan was conducted.

A verification certificate or updated passing score does not constitute a legal safe-harbor, an insurance policy, an indemnification bond, or a guarantee against future third-party litigation, demand letters, or cyber breaches.

8. Limitation of Liability & Absolute Damage Cap

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEAKREPORT, GENERATIVE INTELLECTUAL LLC, NOR ANY OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY:

  • + Indirect, special, incidental, consequential, punitive, or exemplary damages;
  • + Loss of profits, loss of revenue, loss of business opportunity, or goodwill impairment;
  • + Costs of procurement of substitute goods or services;
  • + Damages arising from data loss, server downtime, computer malfunction, ransomware attacks, security breaches, unauthorized database access, or malware infections;
  • + Legal fees, settlement payments, statutory fines, or judgments resulting from demand letters, class-action lawsuits, or regulatory enforcement actions under CIPA, TCPA, ADA, or CCPA.

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF LEAKREPORT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

ABSOLUTE MONETARY LIABILITY CAP:

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF LEAKREPORT AND ITS AFFILIATES TO YOU FOR ALL CLAIMS, DISPUTES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF OUR SERVICES EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO LEAKREPORT IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE OCCURRENCE GIVING RISE TO LIABILITY, OR FIFTY DOLLARS ($50.00 USD), WHICHEVER IS LESS.

9. User Indemnification

You agree to fully defend, indemnify, and hold harmless LeakReport, Generative Intellectual LLC, and their respective officers, directors, members, managers, employees, contractors, agents, successors, and assigns from and against any and all claims, demands, liabilities, suits, damages, losses, costs, and expenses (including reasonable attorney fees and court costs) arising out of or resulting from:

  • + Your breach of or failure to comply with any provision of these Terms;
  • + Your submission of any website or domain address without lawful ownership or authorization;
  • + Any claims brought by third parties alleging that your website or digital tracking practices violate wiretapping laws (CIPA), telemarketing statutes (TCPA), accessibility rules (ADA), or data privacy laws;
  • + Your implementation, deployment, or reliance upon any scan findings, remediation instructions, or AI fix prompts provided by LeakReport.

10. Commercial Packages, Pricing & Refund Policy

LeakReport offers one-time commercial audit packages:

    Tier 1: Single Website Report ($19.99): Targeted unredacted evaluation of technical perimeter security or statutory privacy compliance.
  • +
    Tier 2: Complete Website Check ($29.99): Full dual audit dossier combining perimeter security testing with 32-point statutory compliance testing.
  • +
    Tier 3: Complete Check + AI Fix Guide ($49.99): Full dual audit dossier plus turnkey AI fix prompts and priority 60-day re-scan verification.

Digital Deliverable Final Sale: Because audit reports and AI fix guides are instantly accessible, downloadable digital property generated upon order confirmation, all sales are final upon delivery. No refunds are issued once access tokens or download links are generated.

11. Data Retention & 14-Day Automated Purge Policy

Unclaimed website reports, temporary preview links, and finding previews are stored securely and permanently deleted from active systems after fourteen (14) calendar days. Unlocked paid reports remain securely accessible to authorized buyers for the duration specified in the purchased tier.

12. Electronic Communications & TCPA Prior Express Consent

When you submit your telephone number and email address to receive audit findings or schedule a liability walkthrough, you grant prior express written consent to LeakReport to deliver the requested deliverables and communicate regarding perimeter security vulnerabilities and statutory compliance findings via telephone, SMS text messaging, or automated electronic communications.

13. Mandatory Binding Individual Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING WAIVING YOUR RIGHT TO A JURY TRIAL AND PROHIBITING CLASS ACTION LAWSUITS.

Mandatory Individual Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, our website, scan deliverables, or your relationship with LeakReport shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

CLASS ACTION & JURY TRIAL WAIVER:

YOU AND LEAKREPORT EXPRESSLY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS REPRESENTATIVE, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR PRIVATE ATTORNEY GENERAL PROCEEDING. THE ARBITRATOR SHALL HAVE NO AUTHORITY TO COMBINE OR CONSOLIDATE CLAIMS OF MULTIPLE PARTIES. BOTH PARTIES KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY.

Informal Dispute Resolution Period: Prior to initiating arbitration, you agree to provide written notice detailing the dispute to reports@leakreport.io and allow thirty (30) days for good-faith informal negotiation.

One-Year Limitation on Claims: Any arbitration or legal proceeding arising out of or related to these Terms must be filed within one (1) year after the underlying cause of action accrued, or it is permanently barred.

14. Governing Law & Exclusive Jurisdiction

These Terms and any dispute arising hereunder shall be governed by, construed, and enforced in accordance with the substantive laws of the State of Wyoming, United States, without regard to its conflict of law principles. To the extent any dispute is deemed non-arbitrable by a court of competent jurisdiction, the parties consent to exclusive personal jurisdiction and venue in the state or federal courts located in Wyoming.

15. Severability & Entire Agreement

If any provision of these Terms is determined by an arbitrator or court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and all remaining provisions of these Terms shall remain in full force and effect.

These Terms and our Privacy Policy constitute the entire, complete, and integrated agreement between you and LeakReport concerning your access to our website and services, superseding all prior oral or written negotiations, representations, or understandings.
